MAZZZING, INC. GIFT CARD TERMS AND CONDITIONS

I. INTRODUCTION AND ACCEPTANCE OF TERMS

These Terms and Conditions (“Terms”) govern the purchase, issuance, use, and redemption of gift cards issued by Mazzzing, Inc. (“Company,” “we,” “us,” or “our”) for use with Mazzzing software services and subscriptions. By purchasing, accepting, or using a Mazzzing gift card (“Gift Card”), you (“Purchaser,” “Cardholder,” or “you”) acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

These Terms constitute a legally binding agreement between you and Mazzzing, Inc. Your purchase or use of a Gift Card indicates your acceptance of these Terms. If you do not agree to these Terms, do not purchase or use the Gift Card. These Terms may be modified by Company at any time without prior notice, and such modifications shall be effective immediately upon posting. Your continued use of the Gift Card after any such modifications constitutes your acceptance of the modified Terms.

The Gift Card is subject to all applicable federal, state, and local laws and regulations, including but not limited to the Credit Card Accountability Responsibility and Disclosure Act of 2009 and Kansas gift card statutes. These Terms supplement and do not replace any applicable law.

II. GIFT CARD PURCHASE AND ISSUANCE

A. Purchase Requirements and Payment Methods

Gift Cards may be purchased at authorized retail locations, through our website, or through other authorized channels designated by Company. To complete a Gift Card purchase, you must provide a valid email address for purchase confirmation and balance inquiry purposes. The email address provided must be accurate and accessible to you, as it will serve as the primary method for purchase verification and customer service communications.

Company accepts the following payment methods for Gift Card purchases: credit cards, debit cards, and cash (where applicable at retail locations). All Gift Card purchases are final and non-refundable except as required by applicable law. Payment must be received in full before the Gift Card will be activated and made available for use.

Upon successful purchase and payment processing, you will receive a purchase confirmation via the email address provided. This confirmation will include the Gift Card number, initial balance, purchase date, and expiration date. You are responsible for maintaining the confidentiality of your Gift Card information and for any unauthorized use that may occur prior to notification to Company.

B. Minimum and Maximum Value Restrictions

Each Gift Card must be loaded with a minimum value of five dollars ($5.00) and may not exceed a maximum value of one thousand dollars ($1,000.00). Company reserves the right to refuse any purchase request that does not meet these value requirements or that appears to be part of suspicious or fraudulent activity.

The value loaded onto the Gift Card represents the maximum amount that may be redeemed for Mazzzing software services and subscriptions. This value does not earn interest and is not insured by the Federal Deposit Insurance Corporation or any other governmental agency.

C. Single-Use and Non-Reloadable Terms

Gift Cards are issued as single-use, non-reloadable cards. Once the initial value is loaded onto the Gift Card at the time of purchase, no additional funds may be added to the card under any circumstances. If you wish to purchase additional value for Mazzzing services, you must purchase a separate Gift Card.

Each Gift Card is uniquely identified by a card number and security code. The Gift Card becomes active immediately upon successful payment processing and will remain active until the expiration date specified herein, subject to complete redemption of the card value.

III. EXPIRATION AND VALIDITY PERIOD

In accordance with federal law under 15 U.S.C. § 1693l-1 and Kansas state law under K.S.A. 50-6,108, each Gift Card will expire five (5) years from the date of purchase. The expiration date will be clearly printed on the Gift Card and included in your purchase confirmation email.

After the expiration date, the Gift Card will become void and any remaining balance will be forfeited. Company will not provide any refund, replacement, or extension for expired Gift Cards. It is your sole responsibility to use the Gift Card before the expiration date.

The five-year validity period begins on the date of purchase, not the date of first use. Partial use of the Gift Card does not extend the expiration date. Company is not required to provide advance notice of impending expiration beyond the expiration date printed on the Gift Card and packaging materials.

IV. FEES AND CHARGES

Company will not charge any fees on Gift Cards at any time during the validity period. This includes, but is not limited to, activation fees, maintenance fees, dormancy fees, inactivity fees, or any other service charges. The full value loaded onto the Gift Card will remain available for redemption until the card expires or the balance is fully utilized, whichever occurs first.

This no-fee policy applies throughout the entire five-year validity period and is in compliance with federal regulations under 15 U.S.C. § 1693l-1 and Kansas state requirements under K.S.A. 50-6,108, which mandate a minimum twelve-month fee-free period. Company’s policy exceeds these minimum requirements by maintaining a no-fee structure for the entire validity period.

V. REDEMPTION TERMS AND RESTRICTIONS

A. Acceptable Use for Software Services

Gift Cards may be redeemed exclusively for any Mazzzing software services or subscriptions offered by Company. This includes all current and future software products, subscription plans, and related services made available through Company’s platform. Gift Cards cannot be used to purchase physical merchandise, third-party products, or services not directly provided by Mazzzing, Inc.

To redeem a Gift Card, you must create or access an existing Mazzzing account and agree to Company’s End User License Agreement. The terms of the End User License Agreement will govern your use of any software services or subscriptions purchased with the Gift Card.

Redemption of Gift Cards is subject to availability of the requested software services or subscriptions. Company reserves the right to discontinue or modify any software services, and such changes do not affect the validity of outstanding Gift Cards, which may be used for alternative available services of equivalent or lesser value.

B. No Cash Redemption Policy

In accordance with Kansas law under K.S.A. 50-6,108, Gift Cards cannot be redeemed for cash, check, or any other form of monetary payment under any circumstances. Gift Cards have no cash value and cannot be exchanged for legal tender. This restriction applies regardless of the remaining balance on the Gift Card or the reason for the redemption request.

Gift Cards cannot be used to purchase other gift cards or prepaid cards. Any attempt to convert Gift Card value to cash through unauthorized means may result in cancellation of the Gift Card without refund.

C. Partial Use and Remaining Balance Terms

When a Gift Card is used for a purchase that is less than the total Gift Card balance, the remaining balance will stay on the card for future use. You may make multiple purchases using the same Gift Card until the balance is fully depleted or the card expires, whichever occurs first.

If the cost of your selected software service or subscription exceeds the remaining Gift Card balance, you must pay the difference using an acceptable payment method. Company does not provide credit or refunds for unused portions of Gift Card balances, except as required by applicable law. You are responsible for tracking your Gift Card balance and ensuring sufficient funds are available for intended purchases. Company recommends checking your balance before attempting to make a purchase to avoid transaction failures.

VI. TRANSFER AND ASSIGNMENT RESTRICTIONS

Gift Cards are non-transferable and tied to the original purchaser. Gift Cards cannot be sold, assigned, transferred, or given to another person under any circumstances. Any attempt to transfer ownership of a Gift Card will result in immediate cancellation of the card without refund or replacement.

The email address provided at the time of purchase serves as the primary identifier for the Gift Card owner. Only the person associated with the purchase email address may use the Gift Card for redemption purposes. Company may require verification of identity before processing Gift Card redemptions.

Gift Cards are intended for personal use only and cannot be used for commercial resale or distribution. Any commercial use of Gift Cards is strictly prohibited and may result in legal action.

VII. BALANCE INQUIRY AND CUSTOMER SERVICE

You may check your Gift Card balance through the following methods:

Online Balance Check: Visit our website at www.mazzzing.com and enter your Gift Card number and security code in the designated balance inquiry section.

Customer service representatives can assist with balance inquiries, redemption questions, and general Gift Card support. When contacting customer service, you must provide your Gift Card number and the email address used for the original purchase for verification purposes.

Our customer service team is available to assist with Gift Card-related inquiries at info@mazzzing.com. Response times for email inquiries may vary, and we recommend using the online balance check or phone support for immediate assistance.

Company maintains records of Gift Card purchases, redemptions, and balance information for the duration of the validity period plus any additional time required by applicable law.

VIII. LOST, STOLEN, OR DAMAGED CARD POLICY

Gift Cards should be treated like cash. Company is not responsible for lost, stolen, damaged, or destroyed Gift Cards and will not provide replacements under any circumstances. Once a Gift Card is issued, Company cannot cancel, replace, or refund the card except as required by applicable law.

You are solely responsible for safeguarding your Gift Card and protecting the card number and security code from unauthorized use. If you suspect unauthorized use of your Gift Card, you must notify Company immediately at Local/Toll: +1-647-601-0649 | Ext: 301 / North America Toll Free: +1-888-629-9964 | Ext: 301 or info@mazzzing.com However, Company cannot guarantee recovery of funds or replacement of the Gift Card.

To minimize risk of loss, Company recommends:

Keeping Gift Cards in a secure location
Recording Gift Card numbers and security codes separately from the physical card
Using Gift Cards promptly after purchase
Regularly checking Gift Card balances

IX. REQUIRED FEDERAL AND STATE DISCLOSURES

In compliance with federal regulations under 12 CFR 1005.20 and applicable state law, the following disclosures are provided:

Expiration Date: This Gift Card expires five (5) years from the date of purchase as printed on the card.
Fees: No fees will be charged on this Gift Card at any time during the validity period.
Terms and Conditions: Complete terms and conditions are printed on the Gift Card packaging and are available upon request.

No Cash Value: This Gift Card cannot be redeemed for cash except as required by applicable law. Governing Law: This Gift Card is subject to Kansas state law and federal regulations governing gift cards.

These disclosures are provided to ensure compliance with applicable consumer protection laws and to inform purchasers of their rights and obligations regarding Gift Card use.

X. DISPUTE RESOLUTION AND MANDATORY ARBITRATION

Any dispute, claim, or controversy arising out of or relating to these Terms, the Gift Card, or your relationship with Company shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association. The arbitration will take place in Johnson County, Kansas, or at another location mutually agreed upon by the parties. The arbitrator’s decision will be final and binding, and judgment may be entered upon it in any court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Company. All disputes must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

This arbitration provision survives termination of these Terms and continues to apply even after your Gift Card has expired or been fully redeemed.

XI. GOVERNING LAW AND JURISDICTION

These Terms and all matters relating to Gift Cards are governed by the laws of the State of Kansas and applicable federal law, without regard to conflict of law principles. Any legal action not subject to the arbitration provision must be brought in the state or federal courts located in Johnson County, Kansas.

The Kansas Consumer Protection Act under K.S.A. 50-6,102 and related consumer protection laws apply to Gift Card transactions. Company complies with all applicable state and federal regulations governing gift card issuance and redemption.

If any provision of these Terms conflicts with applicable law, the law will prevail, but the remainder of these Terms will remain in full force and effect.

Fraud Reporting: If you suspect unauthorized use of your Gift Card, you must report it within 30 days of discovery by contacting customer service immediately.

XIII. MISCELLANEOUS PROVISIONS

Integration with End User License Agreement: Use of software services and subscriptions purchased with Gift Cards is subject to Company’s End User License Agreement. The End User License Agreement contains additional terms and conditions that govern your use of Mazzzing software services.

Entire Agreement: These Terms constitute the entire agreement between you and Company regarding Gift Cards and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral, relating to the subject matter hereof.

Severability: If any provision of these Terms, or any portion thereof, is held to be invalid, illegal, void, or unenforceable by any court or tribunal of competent jurisdiction, the remainder of these Terms shall remain in full force and effect to the maximum extent permitted by law. The parties agree that any such invalid, illegal, void, or unenforceable provision shall be modified and limited in its effect to the extent necessary to cause it to be enforceable, or if such modification is not possible, shall be deemed severed from these Terms.

Waiver: Company’s failure to enforce any provision of these Terms or to exercise any right hereunder shall not constitute a waiver of such provision or right. No waiver by Company shall be effective unless it is in writing and signed by an authorized representative of Company.

Assignment: You may not assign or transfer your rights or obligations under these Terms without Company’s prior written consent. Company may assign these Terms and its rights and obligations hereunder at any time without notice to you.

Force Majeure: Company shall not be liable for any failure or delay in performance under these Terms that is due to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, riots, civil disorders, rebellions, or other similar causes beyond Company’s reasonable control.

Survival: The provisions of these Terms that by their nature should survive termination or expiration shall survive, including but not limited to dispute resolution, governing law, and limitation of liability provisions.

Electronic Communications: You consent to receive communications from Company electronically, including via email to the address provided during Gift Card purchase. Electronic communications satisfy any legal requirement that communications be in writing.

Modification: Company reserves the right to modify these Terms at any time by posting updated Terms on its website or through other reasonable means of notice. Your continued use of the Gift Card after such modifications constitutes acceptance of the modified Terms.

IMPORTANT NOTICE: Please read these Terms carefully and retain a copy for your records. By purchasing or using this Gift Card, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
